When is a family law valuation required?
If you are considering legal separation or divorce, first get professional legal advice. Your family law solicitor will advise you if a family law valuation is required.
Family law valuations are most often requested by
- People who are undergoing a legal separation or divorce
- Couples undergoing mediation
In the case of legal separation or divorce, it’s common practice for each party to get a family law valuation. These are generally undertaken by different companies. We can represent both sides once both parties and their solicitors are in agreement. When either partner owns, or partially owns, more than one property these properties will need to be valued too.
Who can undertake a family law valuation?
Only an RICS Registered Valuer or a TEGOVA Registered Valuer can undertake a family law valuation. The Royal Institution of Chartered Surveyors (RICS) and The European Group of Valuers Associations are the professional bodies that ensures the highest international standards. A valuation undertaken by an RICS registered valuer/TEGOVA valuer may also be called a ‘Red Book Valuation’/ ‘Blue Book Valuation’.

How do I prepare for a family law valuation?
The valuer will need to access the property, inside and out. Unlike a regular valuation, there’s no need to prepare the house. The valuer will measure, take details, and take photos, but these are for the purpose of the report only. Our valuers can see beyond decorative details and untidiness, to accurately value the property.
The process usually takes less than an hour and no additional documentation is required.

How soon will I receive my Family Law Valuation Report?
At Sherry Fitzgerald we usually have a Family Law Valuation Report within 48 hours of the inspection.
My house has recently been valued by an estate agent. Can I use the existing report as a family law valuation?
No. A Market Appraisal Report is provided by a sales agent when you are considering selling your property. It offers guidance on the market value, sales and marketing strategy, and advice on preparing the property for sale. A Market Appraisal Report does not meet the criteria for a family law valuation. A family law valuation is an official document and must be undertaken by a registered valuer.
What happens if my case goes to court?
A Family Law Valuation Report is a legal document outlining the advised market value of a property. It can be used in court proceedings. If necessary, your Sherry FitzGerald registered valuer can attend court as an expert witness.
Any additional costs incurred for court attendance will be relayed to you in advance.
